1. Acceptance of Terms

By downloading, installing, or using HyperArc ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

2. License Grant

HyperArc grants you a limited, non-exclusive, non-transferable license to use the Software on your personal devices, subject to these Terms.

A one-time purchase grants you a lifetime license to HyperArc with all features. Each license includes up to 3 device activations. You may deactivate a device and activate a new one at any time.

3. Bring Your Own Key (BYOK)

HyperArc requires a Google Gemini API key to index files. You are responsible for obtaining and managing your own API key. Your use of the Gemini API is subject to Google's terms of service. Any costs incurred from API usage are your responsibility.

4. Your Data

HyperArc processes files locally on your machine. We do not have access to your files, your API key, or your local database. You retain full ownership and control of all your data. See our Privacy Policy for details.

5. Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the Software, except where applicable law expressly permits.
• Redistribute, sublicense, or resell the Software or your license key.
• Use the Software for any unlawful purpose or in violation of any applicable laws.
• Share your Pro license key publicly or with unauthorized users.

6. Intellectual Property

HyperArc and its original content, features, and functionality are owned by HyperArc and are protected by copyright, trademark, and other intellectual property laws. The Software is licensed, not sold.

7. Updates

Pro license holders receive all future updates at no additional cost. We reserve the right to modify, suspend, or discontinue any part of the Software at any time. We will make reasonable efforts to notify users of significant changes.

8. Disclaimer of Warranties

The Software is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, HyperArc shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total liability for any claim arising from or related to the Software shall not exceed the amount you paid for the Software.

11. Termination

We may terminate or suspend your license immediately if you breach these Terms. Upon termination, you must cease all use of the Software and destroy any copies in your possession.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Software after changes constitutes acceptance of the updated Terms.
